Ignition Performance Coach

These Terms of Use (“Terms”) govern your access to and use of Ignition Performance Coach, including its website, training platform, beta features, coaching tools, practice simulations, scoring, and related services (collectively, the “Service”).

Ignition Performance Coach is currently being developed and tested. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

For purposes of these Terms, “Ignition,” “we,” “us,” and “our” refer to the operator of Ignition Performance Coach.

1. Purpose of Ignition Performance Coach

Ignition Performance Coach is an automotive sales training and professional-development platform designed to help automotive salespeople learn, practice, and improve customer-facing sales skills.

The Service may include:

  • training lessons;
  • guided customer simulations;
  • AI-generated coaching;
  • role-play practice;
  • performance scoring;
  • skill-development feedback;
  • manager training tools;
  • dealership-specific training content;
  • and other professional-development features.

Ignition is intended as a training and development tool. It does not replace dealership management, dealership policies, professional judgment, finance and insurance personnel, legal advice, compliance advice, or other required professional supervision.

2. Beta Service

Certain portions of Ignition may be offered as part of a beta, pilot, preview, or early-access program.

Beta features may:

  • change during testing;
  • contain errors or incomplete functionality;
  • be unavailable temporarily;
  • be modified or discontinued;
  • include training videos or materials that are still being added;
  • and perform differently as the platform is improved.

Participation in a beta program does not guarantee continued access to the Service or any particular feature. We may modify the beta program at any time as part of product testing and development.

3. Eligibility and Account Access

You must provide accurate information when requesting or creating an account.

Access to Ignition may require approval by a dealership Manager, Administrator, Platform Administrator, or other authorized person.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • using your own account;
  • protecting access to your device;
  • and notifying us if you believe your account has been compromised.

You may not share account credentials with unauthorized users.

We may suspend or terminate access when necessary to protect the Service, other users, dealership information, or platform security.

4. Training and AI-Generated Content

Ignition may use artificial intelligence to generate:

  • simulated customer responses;
  • coaching;
  • feedback;
  • scores;
  • practice scenarios;
  • recommendations;
  • summaries;
  • and other training content.

AI-generated content may not always be accurate, complete, or appropriate for every real-world situation. Users are expected to apply professional judgment and follow their dealership's approved policies, procedures, legal requirements, and management direction.

Ignition should not be relied upon as the sole source for decisions involving:

  • vehicle pricing;
  • financing approvals;
  • interest rates;
  • taxes;
  • legal disclosures;
  • warranties;
  • incentives;
  • lender requirements;
  • regulatory compliance;
  • employment decisions;
  • or other matters requiring authoritative information.

If Ignition-generated guidance conflicts with dealership policy, applicable law, or instructions from authorized dealership management, the applicable policy, law, or authorized instruction controls.

5. Sales Training Is Not a Guarantee of Results

Ignition is designed to support skill development.

We do not guarantee:

  • increased sales;
  • increased closing ratios;
  • increased gross profit;
  • specific performance improvements;
  • increased commissions;
  • increased dealership revenue;
  • customer satisfaction scores;
  • employment advancement;
  • or any particular business result.

Sales performance depends on many factors outside the control of Ignition.

6. Practice Scores and Performance Information

Scores, skill assessments, coaching recommendations, and performance trends within Ignition are intended for training and developmental purposes.

Scores are based on the information and behavior available to the system during a particular training interaction.

A score should not be interpreted as an absolute measurement of a person's overall ability, professional value, employment performance, or suitability for employment.

Dealerships and managers are responsible for determining how training information is used within their organizations and for complying with applicable employment and privacy laws.

7. User Content

You may provide information to Ignition through:

  • typed responses;
  • voice transcription;
  • practice conversations;
  • captured sales situations;
  • feedback;
  • scenario descriptions;
  • and other content you submit to the Service (“User Content”).

You retain ownership of your User Content to the extent permitted by law.

By submitting User Content, you grant us permission to process, store, analyze, and use that content as reasonably necessary to:

  • provide the Service;
  • generate coaching and feedback;
  • maintain performance history;
  • improve platform functionality;
  • troubleshoot problems;
  • protect platform security;
  • and operate the beta program.

Do not submit information that you are not authorized to provide.

8. Customer and Sensitive Information

Users should avoid entering unnecessary sensitive customer information into Ignition.

Unless specifically required by an approved feature, do not enter:

  • Social Security numbers;
  • credit card numbers;
  • bank account information;
  • complete credit applications;
  • driver's license numbers;
  • passwords;
  • highly sensitive financial information;
  • or other information that is unnecessary for training.

Training scenarios should use only the information reasonably necessary to understand and practice the sales interaction.

9. Dealership Information

Some users may have access to dealership-specific content, including:

  • training materials;
  • processes;
  • playbooks;
  • assignments;
  • team information;
  • performance information;
  • or other internal dealership content.

You may use this information only for authorized business and training purposes. You may not intentionally access information belonging to another dealership or organization without authorization.

10. Acceptable Use

You agree not to use Ignition to:

  • violate any law or regulation;
  • impersonate another person;
  • gain unauthorized access to another account or dealership;
  • interfere with platform security;
  • reverse engineer or attempt to extract proprietary platform logic except where legally permitted;
  • copy or redistribute proprietary training content without authorization;
  • upload malicious code;
  • harass, threaten, discriminate against, or abuse another person;
  • generate deceptive or fraudulent sales practices;
  • fabricate pricing, incentives, financing approvals, or other transaction information;
  • or use the Service for unlawful or harmful purposes.

We may restrict access when we reasonably believe the Service is being misused.

11. Professional Standards

Ignition is designed around professional, transparent, customer-centered automotive sales practices.

Nothing in the Service authorizes a user to:

  • misrepresent vehicle availability;
  • misrepresent pricing;
  • fabricate discounts;
  • fabricate incentives;
  • guarantee financing approval;
  • misstate financing terms;
  • misrepresent trade values;
  • conceal required fees;
  • or make promises the dealership has not authorized.

Users remain responsible for the representations they make to real customers.

12. Intellectual Property

Ignition Performance Coach and its associated:

  • software;
  • branding;
  • training structure;
  • workflows;
  • scoring systems;
  • lesson designs;
  • written content;
  • graphics;
  • interfaces;
  • simulations;
  • and proprietary methodologies

are owned by or licensed to the operator of Ignition Performance Coach and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not copy, reproduce, sell, sublicense, distribute, modify, or commercially exploit proprietary Ignition content without written permission.

Your use of the Service does not transfer ownership of Ignition intellectual property to you.

13. Feedback

We welcome comments, suggestions, bug reports, and other feedback, particularly during beta testing.

If you provide feedback about Ignition, you agree that we may use that feedback to develop, modify, improve, market, or operate the Service without compensation or obligation to you.

This does not give us ownership of unrelated confidential information you provide.

14. Third-Party Services

Ignition may rely on third-party technology or services for functionality such as:

  • hosting;
  • authentication;
  • artificial intelligence;
  • speech transcription;
  • email;
  • video;
  • analytics;
  • or infrastructure.

Those services may be governed by their own terms and privacy practices. We are not responsible for third-party services outside our reasonable control.

15. Availability of the Service

We may update, modify, suspend, or temporarily interrupt the Service for:

  • maintenance;
  • security;
  • development;
  • product improvements;
  • beta testing;
  • or other operational reasons.

We do not guarantee uninterrupted or error-free availability.

16. Disclaimer of Warranties

To the fullest extent permitted by law, Ignition Performance Coach is provided “as is” and “as available.”

We make no warranty that:

  • the Service will always be available;
  • every AI response will be accurate;
  • every scenario will perfectly reflect a real customer;
  • every score will represent a definitive assessment of ability;
  • or use of the Service will produce a particular sales or business outcome.

Nothing in these Terms excludes warranties that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, the operator of Ignition Performance Coach and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Service.

This includes, where legally permitted, loss of:

  • revenue;
  • commissions;
  • profits;
  • customers;
  • business opportunities;
  • data;
  • or goodwill.

Nothing in these Terms limits liability that cannot legally be limited.

18. Suspension or Termination

We may suspend or terminate access to Ignition if:

  • these Terms are violated;
  • an account creates a security risk;
  • access is no longer authorized by the dealership;
  • the beta program ends;
  • the Service is discontinued;
  • or continued access could harm the Service or other users.

Users may stop using Ignition at any time.

19. Changes to These Terms

We may update these Terms as Ignition develops.

When material changes are made, we may update the effective date and provide notice where appropriate.

Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.

20. Privacy

Use of Ignition is also subject to our Privacy Policy. The Privacy Policy explains how information may be collected, used, stored, and otherwise handled when using the Service.

21. Governing Law

These Terms will be governed by applicable law, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute will be handled in the courts or other forum having proper jurisdiction under applicable law.
